Pool Party™ is a recreational card game created for adults aged 21 and over. By purchasing, opening, possessing, or using the Pool Party™ game, you acknowledge that you have read, understood, and agreed to the following legal terms, and that you voluntarily assume all risks associated with gameplay. This includes full and unconditional release of Ferreros LLC (doing business as Pool Party Social), its owners, affiliates, agents, distributors, contractors, and partners, from any and all liability, claims, damages, injuries, losses, or other legal actions that may arise from use, misuse, or interpretation of the game.
Pool Party™ includes social, physical, and water-based prompts that may involve physical activity or the optional consumption of alcoholic beverages. Participation in any such activity is entirely voluntary and at your own risk. Alcohol is not required to play Pool Party™. If you choose to consume alcohol while playing, you accept full personal responsibility for your behavior and safety, and agree to indemnify and hold harmless Ferreros LLC from any consequence arising from intoxication, overconsumption, or alcohol-related incidents, including injury, illness, property damage, emotional distress, or death.
Gameplay may involve water-based environments, such as swimming pools. Engaging in physical activity while under the influence of alcohol or other substances can increase the risk of injury or harm. It is your responsibility to know your limits, take necessary precautions, and prioritize the safety of yourself and others. We recommend playing Pool Party™ without alcohol for the safest possible experience.
All gameplay is self-moderated. Participants are encouraged to skip, modify, or substitute any card that feels unsafe, uncomfortable, or inappropriate. The game includes the “Pool Pass Rule,” which allows any player to opt out of a prompt at any time, without explanation or penalty.
By playing, you agree that Pool Party™ is for entertainment purposes only and should not replace common sense, sound judgment, or appropriate supervision. Do not play the game while intoxicated, unwell, or in unsafe environments. The game is not intended to treat, cure, or influence any physical, emotional, or psychological condition.
Ferreros LLC is not responsible for the actions, behavior, decisions, or safety of players during or after gameplay. The company is not liable for any content captured, shared, or posted during use of the game, including user-generated content shared publicly or privately. Players are responsible for obtaining proper consent before recording or publishing content involving others.
By using the product, you waive the right to participate in any class action or group legal proceeding related to the use of the game. All claims must be resolved through individual arbitration in accordance with the laws of the state in which Ferreros LLC is incorporated. This agreement is binding on all users, purchasers, and participants and shall be enforceable to the fullest extent permitted by law.
This product is sold by Ferreros LLC, a Texas limited liability company. By purchasing, opening, or using this game, you agree that any dispute, claim, or controversy arising out of or relating to this product or its use shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA), in accordance with its Consumer Arbitration Rules.
All arbitration proceedings shall be conducted in Travis County, Texas, and governed by the laws of the State of Texas, without regard to conflict of laws principles.
You waive any right to a trial by jury and agree that any arbitration shall be conducted only on an individual basis, and not in a class, consolidated, or representative action.
